Terms of Use

Please read these terms carefully.

Effective Date: July 30, 2026

FidelityFirst.com

These Terms of Use (“Terms”) govern your access to and use of FidelityFirst.com and related pages, forms, tools, content, and services operated by Fidelity First. By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.

1. Informational Purpose; No Guarantee of Coverage

Website content is provided for general informational and educational purposes. It is not legal, tax, accounting, medical, or investment advice and does not create an insurer-insured, adviser-client, fiduciary, or other professional relationship. Insurance availability, eligibility, benefits, premiums, cost-sharing, provider networks, formularies, underwriting, and effective dates are determined by applicable law, the issuing carrier, and the governing policy or contract.

Submitting a form, requesting a quote, speaking with an agent, or completing an application does not guarantee eligibility, coverage, issuance, approval, enrollment, or an effective date. Coverage is not effective until confirmed by the applicable carrier or plan.

2. Insurance and Medicare Disclosures

Fidelity First is an independent insurance agency and is not an insurance company. We may not offer every plan or product available in your area. Product availability varies by state, county, carrier appointment, eligibility, and other factors. You should review official plan and policy documents before making a decision.

Fidelity First and its agents are not connected with or endorsed by the U.S. government or the federal Medicare program. Medicare-related pages must display any then-current TPMO disclaimer required for the particular page, marketing activity, or geographic scope.

3. No Emergency or Medical Service

The website is not an emergency, medical, or healthcare service. Do not use it to request emergency assistance or urgent medical advice. Call 911 or an appropriate healthcare professional when necessary.

4. Eligibility and Acceptable Use

You must be at least 18 years old and legally able to agree to these Terms. You agree to provide accurate information and to use the website lawfully. You may not:

  • Attempt to gain unauthorized access to the website, accounts, systems, or data.
  • Introduce malicious code, interfere with security, overload systems, scrape content unlawfully, or reverse engineer website functionality.
  • Impersonate another person, submit false or misleading information, or use another person’s information without authorization.
  • Copy, republish, sell, exploit, or create derivative works from protected website content except as permitted by law or with written authorization.
  • Use the website for unlawful, fraudulent, abusive, or infringing activity.

5. Quotes, Applications, and Electronic Communications

Quotes and comparisons are estimates based on information available at the time and may change. You are responsible for reviewing application answers and policy or plan documents for accuracy. You consent to receive electronic records and communications when you choose electronic delivery, subject to your right to request another available format.

Consent to receive marketing text messages is optional and is governed by the SMS Terms and the specific disclosure shown at the point of opt-in. Consent to marketing is not a condition of purchasing any property, goods, or services.

6. Intellectual Property

The website and its text, graphics, logos, designs, downloads, software, and other content are owned by Fidelity First or its licensors and are protected by intellectual-property laws. Fidelity First grants you a limited, revocable, nonexclusive, nontransferable license to use the website for personal, lawful, noncommercial purposes.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FIDELITY FIRST DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIDELITY FIRST AND ITS OWNERS, AGENTS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE WEBSITE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LEGALLY BE EXCLUDED.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Fidelity First and its owners, agents, employees, and contractors from claims, losses, liabilities, and expenses arising from your unlawful misuse of the website, your violation of these Terms, or your infringement of another person’s rights.

11. Privacy

Our Privacy Policy explains how we handle personal information. The Privacy Policy is incorporated by reference into these Terms.

12. Changes; Suspension; Termination

We may update the website or these Terms, and may suspend or terminate access when reasonably necessary for security, maintenance, legal compliance, or misuse. Updated Terms will be posted with a revised effective date. Continued use after an update constitutes acceptance to the extent permitted by law.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any dispute not subject to a mandatory alternative process must be brought in a court of competent jurisdiction in Maryland, unless applicable law provides you another right.

14. Severability; Waiver; Entire Agreement

If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms, together with incorporated policies and transaction-specific agreements, constitute the agreement concerning website use.
